CodingGita Program Student Agreement Draft

This Agreement is entered into, by and between: CodingGita Technologies Private Limited, (hereinafter referred to as "CodingGita"), and FATHER NAME father of STUDENT NAME, residing at, ADDRESS AS PER AADHAR CARD (here in after referred to as the "Student").

WHEREAS, CodingGita offers a comprehensive program aimed at equipping students with practical skills and preparing them for internships and job placements; and

WHEREAS, the Student desires to enroll in CodingGita's program and is willing to pay the required fees for the same.

NOW, THEREFORE, in consideration of the mutual covenants contained herein, CodingGita and the Student agree as follows:

Program Duration: The CodingGita program shall have a total duration of 4 years.

Placement Guarantee: After completing 4 years of the CodingGita Program, CodingGita guarantees job offers to the Student with a minimum starting salary of 6 lakhs Cost to Company (CTC) per annum.

Refund Policy: CodingGita Technologies Private Limited maintains a refund policy to address specific situations where students may be eligible for a refund of fees paid for the CodingGita program. The refund policy is as follows:

  • Attendance Requirement for Refund Eligibility: To be eligible for any refund, including the full refund stated below, the Student must maintain a minimum attendance of 80% in each semester of the CodingGita Program. If the Student’s attendance falls below 80% in any semester, the Student shall not be eligible for any refund, irrespective of placement outcomes or any other circumstances. Attendance records maintained by CodingGita shall be final and binding.
  • Full Refund Post-Graduation: After completing 4 years of the CodingGita Program, if a student doesn't get a job with a minimum starting salary of 6 lakhs Cost to Company (CTC) per annum within 6 months of graduation, CodingGita will give the student a full refund of the fees paid for the CodingGita Program, excluding the GST (Goods and Services Tax) amount. To get this refund, the student must send an email or send a written request to the CodingGita Program Manager.
  • Refund Processing Time: CodingGita will make reasonable efforts to process refund requests promptly, typically within 15 days from the date of receiving the written request.
  • Mid-Semester Withdrawal: If a student decides to leave the program in the middle of a semester, the fees for that particular semester will not be refundable. However, if the student chooses to opt out of the program starting from the next semester, they will not be required to pay fees for the upcoming semesters.
  • Non-Refundable University Fees: Please note that the refund policy outlined here pertains exclusively to CodingGita fees. Any university-related fees, including but not limited to tuition fees, are non-refundable and will be subject to the policies and guidelines of the state private university.

Flexibility to Leave: The Student has the option to leave the CodingGita program at any time without further financial obligation to CodingGita. If the Student chooses to leave, they will not be required to pay fees for the subsequent semester(s) to CodingGita.

Intellectual Property Rights: Any creations, inventions, or intellectual property developed by the student during the program are owned by the student, with CodingGita retaining the right to use these for academic and marketing purposes.

Rights and Responsibilities of the Student: Students are expected to uphold academic integrity, participate actively in all components of the program, and adhere to the code of conduct. Any breach of the academic integrity policy, such as plagiarism, may result in disciplinary action.

Publicity and Use of Student Likeness: The contract allows CodingGita to use student testimonials or images in promotional materials, with student consent. For example, a student’s success story could be featured in CodingGita’s marketing brochures.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Gujarat, India.
